MEETING

WEDNESDAY, 7:00 PM JULY 21, 2004

Chairman Nettleton called the meeting to order, and established a quorum. Members of the Elmore County Planning and Zoning Commission present were Chairman Nick Nettleton, Vice-Chairman Al Sobtzak, Patty Osborn, Doug King, Courtney Hiler, Todd Waite and K.C. Duerig. Also present were

Attorney of Record Phil Miller and Administrator Mark Russell.

PUBLIC HEARINGS (none)

APPROVE MEETING MINUTES

P. Osborn motioned to accept 06/04/04 minutes as written. D. King seconded. Aye vote was unanimous.

K. Duerig motioned to accept 06/23/04 minutes as written with minor change. C. Hiler seconded. Aye vote was unanimous.

APPROVE MEETING FCOs

1. Bill Heaton - A. Sobtzak motioned to approve. C. Hiler seconded. Aye vote was unanimous.

2. Gayle Hipwell - C. Hiler motioned to approve. P. Osborn seconded. Aye vote was unanimous.

3. Andrea Marchant - C. Hiler motioned to approve. P. Osborn seconded. Aye vote was unanimous.

4. Don MacPherson – P. Miller stated there needed to be a wording change of “there must be approval of access points and use of Old Highway 30 by the jurisdictional Highway Department.”

A. Sobtzak motioned to approve with above change. D. King seconded. aye vote was unanimous.

5. Reyes Lopez – C. Hiler motioned to approve. D. King seconded. Aye vote was unanimous.

6. Wade Carpenter - P. Miller pointed out a typo. P. Osborn motion to accept with typo change. K. Duerig seconded. Role call vote as follows: C. Hiler- recused, A. Sobtzak abstained, D. King abstained, T. Waite – Aye, P. Osborn – Aye, K. Duerig- Aye, and Chairman Nettleton – Aye. Motion carried.

REGULAR MEETING

NEW/OLD BUSINESS

1. JOHN WESTRA – Idaho Department of Water Resources

J. Westra gave a slide presentation and answered questions from the commission regarding water rights and aquifer levels.

2. Amnesty Ordinance – A. Sobtzak motioned to schedule for public hearing. P. Osborn seconded. Aye vote was unanimous.

3. Lone Pine Dairy – A. Sobtzak motioned to postpone. C. Hiler seconded. Aye vote was unanimous.
