COMMISSIONERS MINUTES                                November 30, 2009


The Elmore County Commissioners met in regular session on the above date at 9:00 a.m. in the Commissioners Room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting were Chairman Larry Rose, Commissioners Arlie Shaw and Connie Cruser. Also present was Civil Attorney Buzz Grant and Deputy Clerk Barbara Steele.

Motion by Rose, second by Shaw, to approve the minutes of November 23, 2009.

Clerk Marsa Plummer, Sheriff Rick Layher, and Sgt Laytreda Schultz appeared and the addition to the Emergency Services Building was discussed. Civil Attorney Grant explained how Title III funds could be used. Search and Rescue expenditures can be reimbursed from Title III funds to the County. Research will be done on past search and rescue expenditures that the County can be reimbursed for. Discussion followed on office closures, salaries, and the budget.

The application for cancellation of taxes from Kevin & Janice Cotton was the next item on the agenda. Mr. & Mrs. Cotton appeared and documents were reviewed and the cancellation request was discussed. The Cotton’s will keep in contact with the Deputy Clerk as they try to rectify the situation.

Motion by Rose, second by Shaw, to appoint Jeff Cook to the Fair Board.

Motion by Rose, second by Cruser, to cancel half of the 2009 solid waste fee of $28.08 on Douglas C. King and to cancel half the 2009 solid waste fee of $24.07 on Carlos Powell.

Commissioner Cruser read the Certificates of Residency into the record: Elora Ree Wright, Lori Laine Urfer, Marita Michelle Spealman (Fall 2009 & Spring 2010), Jennifer Belle Parker, and Amber Sue Carrier. Motion by Rose, second by Cruser, to approve the Certificates of Residency as read.

Motion by Shaw, second by Cruser, to sign the letter of support addressed to the Forest Service for four power pole replacements by Idaho Power in the Anderson Ranch Dam area.

Motion by Rose, second by Shaw, to go into Executive Session pursuant to I.C. 67-2345(d) to meet with Social Services Director Marianne Bate to discuss Indigent applications.

Regular session resumed. The following decisions were made:

K-10-09-03 Motion by Shaw, second by Rose, to deny as the application is incomplete and Elmore County is not the last resource.

K-12-08-03 Motion by Cruser, second by Shaw, to approve the release of the lien subject to confirmation from legal regarding the dates and authorize the Chairman to sign the release.

Purchasing studded tires for the ambulances were discussed and approved.

Alan Christy, Growth and Development Director, appeared and gave the Commissioners a November 2009 expense report. Lot splits (letters of information) and fencing requirements were discussed. The Commissioners authorized a check to be prepared for Reyes Lopez on a refund from the Growth and Development Department.

The variance request from applicant Susan Martin was discussed. Motion by Cruser, second by Shaw, to approve a variance request for a one time split in an Agriculture zone.
