COMMISSIONERS MINUTES                                November 9, 2009


The Elmore County Commissioners met in regular session on the above date in the Commissioners room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting were Chairman Larry Rose and Commissioner Arlie Shaw. Also present was Civil Attorney Buzz Grant and Deputy Clerk Barbara Steele. Commissioner Cruser was absent.

Motion by Rose, second by Shaw payroll for October, 2009, in the amount of $364,689.96.

Motion by Rose, second by Shaw, to accept the Recorder’s Office Report, Clerk’s Bail Bond Report and Treasurer’s Office Report for the record only.

Alan Christy, Growth and Development Director, appeared before the Board and gave a report on the conditions included in Letter of Information (LOI) lot splits that dealt with fencing. There were seven (7) in 2007, twelve (12) in 2008, and three (3) in 2009.

The Corder Letter of Information (LOI) lot split was discussed. Motion by Rose, second by Shaw, to approve the Letter of Information, three lot split, for Tim Corder. Motion amended by Rose, second amended by Shaw to add the condition “upon payment of fees”.

The variance request by Lonnie and Cynthia McCullough was discussed. Motion by Rose, second by Shaw, to approve the variance request from Lonnie & Cynthia McCullough for a one time lot split in an Agricultural zone located in Section 23, T4S, R6E, B.M.

The Board reviewed estimates for the replacement of tires for a Growth and Development vehicle. The purchase of a plotter for printing maps will be delivered soon. Planned Unit Developments were discussed.

Chairman Rose read Resolution No. 430-09 into the record:

RESOLUTION NO. 430-09

AT A MEETING OF THE BOARD OF ELMORE COUNTY COMMISSIONERS, STATE OF IDAHO, ON THE 9th DAY OF NOVEMBER 2009, THE FOLLOWING RESOLUTION WAS ADOPTED, TO WIT:

WHEREAS, Elmore County, acting through its Board of County Commissioners, pursuant to I.C. §§ 31-601 and 31-604 has the authority to effectively carry out the duties imposed by the provisions of the Idaho Code and Constitution; and

WHEREAS, the Elmore County Growth and Development Office provides certain public services; and

WHEREAS, I.C. § 67-6519 permits the County to impose a reasonable fee for processing permits under the Idaho Local Land Use Planning Act; and

WHEREAS, a public hearing was held on November 2, 2009, requesting public input on the issue of raising the fees for services provided by the Growth and Department Office; and

WHEREAS, the Board received no objection to the proposed fees; and

NOW, THEREFORE, BE IT RESOLVED by the Elmore County Board of County Commissioners in lawful assembled meeting as follows: The Board authorizes the Growth and Development Office to increase the fees for public services according to the chart attached hereto as “Exhibit A” and incorporated fully herein.

IT IS FURTHER ORDERED That the fee increase will be effective January 1, 2010.

Sheriff Rick Layher, Chief Deputy Nick Schilz, Sgt. Laytreda Schultz, and Alan Roberts, Mountain Home Extrication, joined the meeting.

At 2:00 p.m. the bids for the proposed addition to the Emergency Services Building were opened. The results were: Liercke Construction Inc. $599,500.00, C-2 Construction Inc. $412,000.00, Bidegeaneta Construction Inc. $497,038.00, Hamilton Builders $463,687.00 and Skyline Construction $505,000.00. The bids will be taken under advisement and a decision will be made at a later date.

Discussion followed on the bids. Bob Winterfeld, Elmore County’s Building Official, and Alan Roberts will review the bids.

Alan Roberts, representing Mountain Home Extrication, appeared and discussion followed on a change in State laws for extrication units. Mr. Roberts stated he received a check from the State EMS in the amount of $9,985.00 for the extrication unit.

Worker’s Compensation Insurance was briefly discussed and will be put on the agenda for next week.

The Idaho Certified Local Government Program/historic preservation was reviewed. Civil Attorney Grant recommended that if the County was going to go forth with the program that an Elmore County Employee would need to be designated to be responsible for managing the project. The subject will be put on next weeks agenda.
