COMMISSIONERS MINUTES                                July 6, 2009


The Elmore County Commissioners met in regular session on the above date in the Commissioners Room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting was Chairman Larry Rose, Commissioners Connie Cruser and Arlie Shaw. Also present was Civil Attorney Buzz Grant and Deputy Clerk Barbara Steele.

General discussion was held on current activities. Commissioner Cruser reported our Extension Agent Mir Seyedbagheri needed extra help with potato field inspections and mosquito abatement. Commissioner Cruser phoned Mr. Seyedbagheri and left a message for him to come to the meeting today if he was available. The proposed meeting at the Pine Senior Center on July 15th was discussed. Donations to other entities were discussed.

The Bermensolo Letter of Information (LOI) appeal was discussed. Civil Attorney Grant is preparing the Finding of Facts on the public hearing.

Assessor Jo Gridley appeared and discussed a situation where a fire had destroyed a residence and how the cancellation of taxes on that property are handled.

The purchase of the Jackson Street property was reviewed with Civil Attorney Grant.

A status report on the Domestic Violence Council was given by Civil Attorney Grant.

Brent Butler, Growth and Development Director, appeared to discuss personnel issues, and the comprehensive plan update. Mr. Butler reviewed a 2030 vision of the comprehensive plan.

Also present was Nick Nettleton, Planning and Zoning Commission Chairperson. Mr. Nettleton commented to the Commissioners on some of the topics Mr. Butler reviewed regarding the comprehensive plan. Scott Cook, an applicant for the Growth and Development Director position, was also present.

Motion by Rose, second by Shaw, to go into Executive Session pursuant to I.C. 67-2345(a) to interview Mr. Cook for an possible interim position as the Growth and Development Director.

Regular session resumed, no action was taken as result of the Executive Session.

Discussion followed on revoking Conditional Use Permits that are a year old, with no construction starting on the projects.

Motion by Rose, second by Shaw, to recess for lunch and do a Jail inspection.

Motion by Rose, second by Cruser, to go into Executive Session pursuant to I.C. 67-2345(d) to meet with Social Services Director Marianne Bate to discuss indigent applications.

No new indigent cases were submitted to the Commissioners.

Still in Executive Session a hearing of continuation was held on case K-12-08-03. Present at the hearing were the three Commissioners, Civil Attorney Buzz Grant, Clerk Marsa Plummer, Social Services Director Marianne Bate, the Applicant, Mark Peterson and Ann Kaley representing St. Luke’s Regional Medical Center. Ms. Bate gave an overview of the case. Documents that have been requested but not given to the County were discussed. The hearing will be continued to September 14, 2009 at 2:00 p.m.

Regular session resumed.

Randy Cunningham, Elmore County Resident, came before the Board to discuss issues he is having with his property. Commissioner Shaw phoned Growth and Development Director Brent Butler and asked if he could come to the meeting. The Commissioners asked Mr. Cunningham to wait in the audience until Mr. Butler arrived and they would discuss the property issue.

Monica Bowden, Juvenile Probation Department, and Judge Epis came before the Board to discuss the Juvenile Probation Budget. Ms. Bowden stated her Department would be receiving more funds this year from grants. Decreasing the Juvenile Probation Budget was discussed. Collecting court ordered probation charges from Juveniles was discussed.

Mr. Cunningham left to go visit the Growth and Development Department, returned to the meeting and stated he spoke to Mr. Butler and was informed that Mr. Butler will come out to look at the property and make an assessment tomorrow at 8:00 a.m.

Discussion followed on the subject of hiring an Interim Growth and Development Director.

Motion by Rose, second by Cruser, to add the application for a Catering Permit from Mark Anthony’s Purveyors of Fine Cigars to the Agenda.

Brent Butler, Growth and Development Director, Beth Westerwelle, Planner 1, Growth and Development, and Jim and Charlene Carrie appeared before the Board to request an extension to the Conditional Use Permit for Clear Springs Ranch, LLC. Discussion followed on technicalities between the owner of land, and the applicant, in regard to the Zoning Ordinance. The request for extension will be resubmitted to the Growth and Development Department.

Motion by Rose, second by Cruser, to approve the letter to the Planning and Zoning Commission on the Alternate Energy Holdings, Inc. (AEHI) application to amend the zoning classification.

Betty Ashcraft and Molly Marsh, representing the Western Elmore County Recreation District, came before the Board to inform them that the environmental report has been completed and to thank the Board for their participation.

Robert and Ruth Steele, Elmore County property owners, came before the Board and explained they have divided their property. The division is complete and they are coming before the Board for final approval. Commissioner Shaw phoned Growth and Development Director Mr. Butler at which time the Steele’s were instructed to go to the Growth and Development office regarding the division of their property.
