COMMISSIONERS MINUTES                                April 22, 2009


The Elmore County Commissioners met in special session on the above date in the Commissioners room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting were Chairman Larry Rose and Commissioner Arlie Shaw. Commissioner Connie Cruser was attending another meeting. Also present was Deputy Clerk Barbara Steele and Civil Attorney Buzz Grant.

The special session was held to hold indigent hearings of reconsideration along with old/new business items.

Motion by Rose, second by Shaw, to go into Executive Session pursuant to I.C. 67-2345(d) to hold an indigent hearing on case K-12-08-03. Roll call vote was taken.

CRUSER - ABSENT Motion carried and so ordered.

Present at the hearing were Chairman Larry Rose, Commissioner Arlie Shaw, Civil Attorney Buzz Grant, Social Services Director Marianne Bate, Deputy Clerk Barbara Steele, Ann Caley, St. Lukes Regional Medical Center, and the applicant. Discussion followed, questions were asked and answered. Ms. Caley asked for a continuation on the hearing to gather further information.

Motion by Rose, second by Shaw, to continue case K-12-08-03 to May 18th at 3:00 p.m.

Motion by Rose, second by Shaw, to go into Executive Session pursuant to I.C. 67-2345(d) to hold an indigent hearing on case K-11-08-03. Roll call vote was taken.

Present at the hearing were Chairman Larry Rose, Commissioner Arlie Shaw, Civil Attorney Buzz Grant, Social Services Director Marianne Bate, Deputy Clerk Barbara Steele, the applicant, the applicants daughter, Interpreter Heather Hagen, and Shavon Weimer, representing St. Alphonsus Regional Medical Center. Ms. Bate gave an overview of the case. The overview Ms. Bate gave was interpreted to the applicant. Questions were asked and answered. Commissioner Connie Cruser joined the meeting. The hearing was closed.

Regular session resumed.

Motion by Shaw, second by Rose, to approve case K-11-08-03 with a reimbursement order of $50.00 per month starting May 15, 2009.

A brief discussion followed on procedures for indigent hearings. Civil Attorney Grant will do research on the issue.

Motion by Rose, second, by Shaw, to go into Executive Session pursuant to I.C. 67-2345(d) to hold an indigent reconsideration hearing on K-10-08-03. Roll call vote was taken.

Observers at the hearing were employees from Elmore Medical Center. Ms. Bate gave an overview of the case. Questions were asked and answered.

Motion by Rose, second by Shaw, to continue case K-10-08-03 pending verification from Social Security.

Observers at the hearing were from Elmore Medical Center. Ms. Bate gave an overview of the case. Questions were asked and answered.

Motion by Rose, second by Shaw, to approve case K-10-08-12 with a reimbursement order of a minimum of $25.00 per month, Chairman Rose amended his motion to include all providers bill Medicaid, Commissioner Shaw amended his second.

Correspondence received by mail was reviewed.

Chairman Rose read the Certificates of Residency into the record: Jacob S. Miller, Ashley R. Sievers, Donald E. Harlan, Audrey D. Carl, Steven G. Agenbroad, Luke Q. Loomis, Katherine E.M. Price, Kelsey May Sands, Kevin Scott Shenk, Motion by Rose, second by Cruser, to approve the Certificates of Residency as read.

Motion by Cruser, second by Rose, to add the Equipment Lease Agreement between Elmore County and El-Ada, Inc. to the agenda.

Motion by Cruser, second by Rose, to approve and have the Chairman sign the lease agreement between Elmore County and El-Ada, Inc. stating El-Ada is leasing a 1992 Dodge van from the County.

At 3:30 p.m. the Commissioners met in Executive Session pursuant to I.C. 67-2345(b) to discuss a personnel issue on a motion by Rose, second by Shaw. Roll call vote was taken.

Regular session resumed. A Fair employee personnel issue was discussed.
