COMMISSIONERS MINUTES OCTOBER
20, 2008
The Elmore County Commissioners met in regular session on the above date in the
Commissioner’s Room, basement of the Elmore County Courthouse, 150 South 4th
East, Mountain Home, Idaho.
Present at the meeting were Chairman Arlie Shaw and Commissioner Connie Cruser.
Also present was Deputy Clerk Barbara Steele. Commissioner Larry Rose was absent
due to a family illness.
Chairman Shaw opened the meeting and general discussion followed on
Commissioners current activities and correspondence received by mail was
reviewed.
Motion by Cruser, second by Shaw to approve the minutes of October 14, 2008.

Carl Holmes, Elmore County resident, appeared and discussed the County Budget
with the Commissioners. Mr. Holmes questioned the Commissioner’s salary.
Chairman Shaw explained to Mr. Holmes the job description of the Commissioners.
Discussion followed on how many hours the Commissioners work per week and what
functions they attend throughout the month. Mr. Holmes thanked the Commissioners
for the information.
Civil Attorney Richard Roats joined the meeting.
Lonnie McCullough, 1700 Windemere Drive, Mountain Home, Idaho, appeared
representing the Independent Baptist Church of Mountain Home. Mr. McCullough has
made application for property tax exemption for the church, although the actual
vesting of the property is in several individual names. Mr. McCullough will have
a deed prepared to have the property put in the name of the church and will
re-apply for the property tax exemption.
A small recess was taken. Regular session resumed.
Sheriff Rick Layher appeared and discussion followed on the Glenns Ferry Police
Department Contract. The Glenns Ferry Mayor was scheduled to appear. The
contract will be rescheduled in November for review.
General discussion followed on the new ambulance contract and the Glenns Ferry
Transfer Station.
Motion by Shaw, second by Cruser, to recess for lunch.

Motion by Shaw, second by Cruser, to approve and sign the Economist Agreement
between Elmore County and Johnson Gardner, LLC.

Alan and Adam Crane, Snake River Rubbish, appeared before the Board to discuss
extending the Glenns Ferry Landfill contract as the proposed Transfer Station
has been delayed. Chairman Shaw stated when Commissioner Rose returns the
extension will be discussed again. Chairman Shaw will contact Centra Consulting
and have send the Cranes a copy of the Storm Water Management Plan. The contract
extension was put on the October 27, 2008 agenda.
Motion by Shaw, second by Cruser, to go into Executive Session pursuant to I.C.
67-2345(d) to meet with Social Services Director Marianne Bate. Roll call vote
was taken.

K-03-08-04 and send to CAT.

K-09-08-02 Motion by Cruser, second by Shaw, to deny as not indigent, not last
resource as Farmer’s Insurance is involved, applicant is not cooperating and is
not an Elmore County Resident, no documentation has been received and there has
been no interview to determine indigency.

K-09-08-04 Motion by Shaw, second by Cruser, to deny as not indigent, incomplete
application, application did not appear for interview, not last resource as
applicant has discretionary income to pay the bill and Elmore County is unable
to determine residency as address is not an Elmore County address.

Rayola Jacobson, Eastern Owyhee County Cooperation Weed Management Area
spokesperson, appeared before the Board to discuss the Memorandum of
Understanding she brought for the Commissioners signatures. Ms. Jacobson
explained a grant application is the reason for the Memorandum of Understanding.
Motion by Shaw, second by Cruser, to sign the Eastern Owyhee County Cooperation
Weed Management Area Memorandum of Understanding between Owyhee

County, Elmore County, Bruneau River Soil Conservation District, Idaho
Department of Fish & Game, and Idaho Department of Lands and Bureau of Land
Management, Boise District Office.

Victoria Grimes, 13076 Ditto Creek Road, Tipanuk, Joanne Grimmett, 10941 West
Desert Duck Ave, Tipanuk, and Sheriff Rick Layher appeared before the Board
regarding the Tipanuk Fire District. Ms. Grimes gave the Commissioners a handout
with the concerns of the creation and budget hearings of the Tipanuk Fire
District, the meeting minutes stating they are incomplete, budget hearing
minutes and publications, procedures of the meetings and gaining access to
public records. Ms. Grimmett gave the Commissioners a letter explaining her
position regarding the Tipanuk Fire District. The Commissioners read the letter
and discussion followed. Ms. Grimmett reviewed the publication reflecting the
budget amount stated, and that the budget hearing amount was different. A
lengthy discussion followed on the Tipanuk Fire District and the meetings that
have taken place. Sheriff Layher reported to the Board about the investigation
of the creation of the Tipanuk Fire District that his office is conducting. Ms.
Grimes and Ms. Grimmett are asking for the collection of taxes to be stopped.
Chairman Shaw asked Attorney Roats if that was possible and how the process
works. Attorney Roats stated the Prosecutor will look at all the evidence and
will make a decision if fraud was involved and proceed accordingly.
The public portion of the meeting was held. No public appeared.
