COMMISSIONERS MINUTES June 2, 2008
The Elmore County Commissioners met in regular session on the above date in the
Commissioner’s Room, basement of the Elmore County Courthouse, 150 South 4th
East, Mountain Home, Idaho.
Present at the meeting were Commissioners Larry Rose and Connie Cruser. Chairman
Arlie Shaw was absent. Also present was Clerk Marsa Grimmett and Civil Attorney
Richard Roats.
Election Clerk Vivian Garcia presented the Commissioners with the results from
the Primary Election held on May 27, 2008. The Commissioners reviewed the
information.
Motion by Rose, second by Cruser, to convene as a Board of Canvassers.

Agenda items were discussed. The Request for Proposal for the ambulance has not
been received yet. The anemometers were discussed and will continue to be put on
the agenda until a decision is made.
Commissioner Cruser reported on current activities. Commissioner Cruser also
asked about the Jury Clerk position and Clerk Grimmett stated Trish McCain was
acting as the Jury Clerk, appointed by Judge Epis, and the former Jury Clerk,
who is the Chief Deputy for the Clerk, was supervising and handling the child
support files. Commissioner Cruser also reported on the volunteer ambulance
service in the Pine/Featherville area and their need for new supplies. The grant
for two ambulances was submitted.
Kate Ackerson, Fair Director, met with the Board to discuss the Fairgrounds and
the motorcycle racing and ambulance coverage. Ms. Ackerson discussed the Fair
for this year with the Commissioners and costs.
Tag Hawks, White Knuckle Racing, appeared to discuss requiring an ambulance at
all his races at the County Fairgrounds in Glenns Ferry. Mr. Hawks described
problems with the request. They normally have an EMT on scene that specializes
in motorcycle accidents. The County’s ambulance service and how they respond to
crashes on the race track were discussed. Richard Albright from Northwest
Paramedic Assoc. was phoned, discussion followed and Mr. Hawks and Mr. Albright
will meet later in the week to clarify racing accident issues.
Commissioner Rose read the Tax Cancellations into the record: No. 930 Alfredo
Saucedo $105.20 and No. 931 Dunn Rite Welding & Fabrication-Virgil Coakley
$25.54. Motion by Rose, second by Cruser to approve the tax cancellations as
read in the amount of $130.74.

Commissioner Rose read the Certificates of Residency into the record: Glen D.
Hance and Marcella Amriz. Motion by Rose, second by Cruser to approve the
Certificates of Residency as read.

Correspondence received by mail was reviewed.
The June payroll decrease and possible scenarios regarding solutions were
briefly discussed. The topic is on the agenda for later in the day.

At 1:30 p.m. the Commissioners met with Social Services Director Marianne Bate.
No new cases were presented. Ms. Bate stated several hearings were being
scheduled on appeals.
Department budgets were discussed. The area of impact public hearing was
discussed. A date was set for July 28, 2008 at 6:00 p.m. Deputy Clerk Steele
appeared and questioned if the ordinances would be ready by the publishing date.
The public hearing notice will not be published until the ordinances have been
prepared by the Prosecutor’s Office.
The June payroll decrease was discussed. Present were the Elected Officials,
with the exception of Prosecutor Schindele, and several employees representing
various offices. Treasurer Rose Plympton stated she felt the County should pay
the employees the week they will be shorted as the County has the funds in the
Budget. Commissioner Rose stated when the employee leaves they would owe the
County a weeks pay. Sheriff Layher stated if the employees in his department
don’t have enough comp time he will let them go in the hole and make it up
later. Assessor Gridley stated she thought the decision had been made that the
employee could use comp time or vacation time. Clerk Grimmett stated she had
talked to Chairman Shaw and taking sick leave could also be a possibility for
the employee along with comp time and vacation. Commissioner Cruser stated that
sick leave cannot be used, sick leave is like insurance or a bonus. Commissioner
Cruser stated you can’t take employees in the hole on comp time. Commissioner
Rose stated maybe we should not make the change at all. Discussion followed on
whether employees were hourly or salaried. Commissioner Cruser stated employees
are hourly and ICRMP (Idaho Association of Counties Risk Management Program)
suggested the County needs to come into compliance by having accurate time cards
and not estimating the last week of the month. Having the employee file a
hardship was suggested. Discussion followed and Payroll Clerk Linda Pickett
asked about taking one day of pay a month away from the employee as it was
suggested earlier in the meeting when the Commissioners were discussing the
issue. Sheriff Layher stated he has already paid some of his employees for the
upcoming shortage. Plant Facilities Manager, Dan Collins, stated he wanted the
idea to be presented to every employee. Commissioner Cruser stated there was not
enough time. A vote was taken with the employees and elected officials present
and they voted to have one day’s pay deducted per month for five months.
A public hearing was held at the hour of 4:00 p.m. to hear public comment on an
Ordinance amending the Elmore County Zoning and Development Ordinance adopting
the 2006 version of the International Building Code, the International
Residential Code, Parts I-IV and IX, the International Energy Conservation Code,
the International Mechanical Code and the International Fuel Gas Code; Providing
for fees, providing that a permit is required for installation of a
Mobile/Manufactured Home, providing for exemptions; providing for severability;
repealing conflicting ordinances and providing an effective date. Section 1.
Code Adoption, Section 2. Roof Snow Load, Section 3. Minimum Frost Depth for
Footings, Section 4. Permit Fees, Section 5. Manufactured Homes Installation
Permits, Section 6. Exemptions, Section 7. Severability, Section 8. Repeal of
Conflicting Provisions and Section 9. Effective Date.
Bonnie Sharp, Growth and Development Director, appeared and asked if Ordinance
Number 2003-3 would still be in effect after the above proposed ordinance was
adopted. Civil Attorney Roats stated Ordinance Number 2003-3 would still be in
effect.

AN ORDINANCE AMENDING THE ELMORE COUNTY ZONING AND DEVELOPMENT ORDINANCE
ADOPTING THE 2006 VERSION OF THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL
RESIDENTIAL CODE, PARTS I-IV AND IX, THE INTERNATIONAL ENERGY CONSERVATION CODE
, THE INTERNATIONAL MECHANICAL CODE AND THE INTERNATIONAL FUEL GAS CODE;
PROVIDING FOR FEES, PROVIDING THAT A PERMIT IS REQUIRED FOR INSTALLATION OF A
MOBILE/MANUFACTURED HOME, PROVIDING FOR EXEMPTIONS; PROVIDING FOR SEVERABILITY;
REPEALING CONFLICTING ORDINANCES AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF ELMORE,
IDAHO:
Section 1. Code Adoption: That the approved editions of the following 2006
nationally recognized codes are adopted as the official building codes of the
County of Elmore, except as provided in Section 2:
International Building Code, except for Sections 103.2 and 103.3
International Residential Code, parts I-IV and IX, except for Sections R103.2
and R103.3
International Energy Conservation Code
International Mechanical Code, except for Sections 103.2
International Fuel Gas Code, except for Sections 103.2
The adopted versions of the foregoing codes shall be effective upon adoption.
The foregoing codes shall be deemed superseded by successive versions of such
codes as they are adopted or approved by the state of Idaho effective on the 1st
day of January the year following the date any such codes are made effective for
the state, unless a different date is required by state statute.
Section 2. Roof Snow Load: The roof snow load shall be as the load as adopted
from time to time by the Board of County Commissioners.
Section 3. Minimum Frost Depth for Footings: The minimum frost depth for
footings shall be as adopted by the Board of County Commissioners.
Section 4. Permit Fees: Applicants shall pay permit and plan review fees in
amounts to be determined by Resolution of the Board of County Commissioners. All
permits required under this Ordinance require fees to be paid prior to a permit
being issued, unless specified otherwise herein.
Section 5. Manufactured Homes Installation Permits: Placement of
mobile/manufactured homes shall require an installation permit. The permit
applicant shall supply to the Building Official the same site information
required from an applicant seeking a building permit for a single family
dwelling and shall pay a permit fee as set by resolution of the Board of County
Commissioners.
Section 6. Exemptions: Agricultural buildings, as defined by the International
Building Code, are exempt from the building permit fees as adopted herein but
shall remain subject to the International Building Code Construction, such as
placement, and any other permits established by zoning regulations.
Section 7. Severability. This ordinance is hereby declared to be severable.
Should any portion of this ordinance be declared invalid by a court of competent
jurisdiction, the remaining provisions shall continue in full force and effect
and shall be read to carry out the purpose(s) of the ordinance before the
declaration of partial invalidity.
Section 8. Repeal of Conflicting Provisions. All provisions of the current
Elmore County Zoning and Development Ordinance shall remain in full force and
effect and any conflict with the provisions of this ordinance are hereby
repealed to the extent of such conflict.
Section 9. Effective Date. This ordinance shall be effective upon its passage
and publication as provided by law.

The Request for Proposal for the Ambulance was briefly discussed. Civil Attorney
Roats stated he would check with Prosecutor Schindele on the status of the
Proposal.
