COMMISSIONERS MINUTES                                April 28, 2008

The Commissioners met in regular session on the above date in the Commissioners Room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting were Chairman Arlie Shaw, Commissioners Larry Rose and Connie Cruser. Also present was Clerk Marsa Grimmett.

Mir Seyedbagheri, Extension Agent, appeared before the Commissioners and gave them an update on the planning currently taking place for mosquito abatement this year. Mir also gave the Commissioners a monthly written report on the activities in his office.

Chairman Shaw read the Certificates of Residency into the record: Lisa Ann Cantrell, Emily K. Johns, Anabel Lopez, Timothy A. Novinger, Kaylynn Caresse Smith, two for Gloria Werner, Fall 2008 and Summer 2008. Motion by Rose, second by Cruser, to approve the Certificates of Residency as read and have the Chairman sign.

Chairman Shaw read the tax cancellations into the record: No. 925 Pennys From Heaven $38.74 No. 926 Joe Ortega – Javier Juarez $28.52, No. 927 Thomas Mashburn $4.70, and No. 928 Jose Hernandez $2.78 for a total of $74.74. Motion by Rose, second by Cruser to approve the tax cancellations as read and have the Chairman sign.

Sheriff Rick Layher appeared and gave a brief update on his department. The cost to house State inmates was discussed along with a new fence at the Jail.

Marty Jones, Central District Health, appeared before the Board for his regular monthly meeting. The Glenns Ferry Landfill was briefly discussed.

A public hearing date was set on the appeal from Jim Carrie, Clear Springs Ranch Subdivision for June 30, 2008 at 6:00 p.m. as long as the American Legion Hall is available that night.

The Department Heads met for their regular monthly meeting.

Wade Baumgardner, Veterans Service Officer, appeared and gave his monthly report. Mr. Baumgardner held his outreach meeting up in the Pine/Featherville area and reported on the Veteran’s he helped.

Dan Collins, Plant Facilities Manager, appeared and reported his Department is helping put air conditioning in the Recorder’s Office and part of the Assessor’s office along with replacing ceiling tiles. Other items were discussed, a new door will be installed at the Extension Agent’s office, weather permitting, and items at the new Jail.

Bonnie Sharp, Growth and Development Department, appeared and stated she had the new job descriptions ready and will email them to Marsa for her to send to BDPA, the County’s Salary Survey Company for review. Increasing the fees for the Growth and Development Department were discussed. Ms. Sharp also asked about the suggestions she made regarding the Ordinance adopting the 2006 International Building Code. When Civil Attorney Roats joins the meeting the Commissioners will ask him.

Monica Halliday, Juvenile Probation, joined the meeting. Ms. Halliday reported that her office has been busy as they are short staffed.

A small recess was taken.

Regular session resumed.

Chairman Shaw read another Certificate of Residency into the record: Gregerson H. Hafen. Motion by Cruser, second by Rose, to approve the Certificates of Residency as read.

The expenses were discussed. Motion by Rose, second by Shaw, to approve the expenses in the amount of $217,037.70.

Deputy Clerk Barb Steele appeared before the Commissioners to get authorization to send the Request for Qualifications for Economist and Qualified Planner to the Mountain Home News for publication on April 30, 2008 and May 7, 2008. A public hearing date was re-set to June 2, 2008 at 3:30 p.m. regarding an Ordinance Adopting the 2006 International Building Code.

Marianne Bate, Social Services Director, appeared before the Board to make a presentation on her job duties. Ms. Bate gave the Commissioners and Clerk packets of information and then reviewed the information with them. Richard Roats asked if Marianne could request the medical providers to have the patients sign a Release of Information, otherwise the application may be denied. Procedures of investigating the indigent application were discussed. Ordering credit reports on applicants, checking the VA status on applicants, and sending a letter to the hospitals stating the County’s expectations will be implemented.

At 1:30 p.m. the Commissioners met in Executive Session pursuant to I.C. 67-2345(d) on a motion by Shaw, second by Rose. Roll call vote was taken.

Still in Executive Session a hearing was held on K-11-07-06. Present at the hearing were the three Commissioners, Civil Attorney Richard Roats, Social Service Director Marianne Bate, Deputy Clerk Barbara Steele, the applicant and the applicant’s father. Chairman Shaw swore the applicant in. Social Service Director Bate gave an overview of the case. The applicant was asked questions. The hearing was closed.

Motion by Shaw, second by Rose, to approve K-11-07-06 with a reimbursement order of $200.00 per month.

The Interim Mosquito Abatement District was briefly discussed. Civil Attorney Roats stated the question can go on the November General Election ballot to create a County wide Mosquito Abatement District. No taxes can be collected retroactively if the District passes.

The elected officials met for their regular monthly meeting.

Motion by Rose, second by Shaw, to approve the request to waive the fee for GIS information for Christopher Corwin who is a student doing a research project.

The elected officials met for their regular monthly meeting.

Present were Marsa Grimmett, Clerk, Rose Plympton, Treasurer, Jo Gridley, Assessor, Jerry Rost, Coroner, and Kristina Schindele, Prosecutor.

Also present was Bob Stephenson and Matt from Stephenson Computers. Matt discussed presenting some computer classes to the employees. Having one person in each office with basic knowledge of computer programs was discussed. That person would be the “go to” person for employees when a computer problem occurred.

Monitoring internet usage by County Employees and having a policy was discussed.

Treasurer Plympton asked the Commissioners about a discrepancy with the Post Office and the bulk mailing permit from last year. The issue will be investigated. Commissioner Rose stated Security will not be handling the mail as of June 1, 2008. It will be up to the individual offices to take care of their own mail as of that date. Discussion followed that mail coming into the Courthouse would be considered a security issue. Discussion followed on why Security is not going to do the mail. The Elected Officials stated they would like to talk to Sheriff Layher regarding the issue. Suspected mold issues in the Courthouse and Prosecutor’s office were discussed.

Jerry Rost, Coroner, explained a situation he has with a deceased gentlemen who he believes is Indigent. The Commissioners told Mr. Rost to file an Indigent application with Social Services Director Marianne Bate.

The Hughes property was discussed, the pigs have knocked down a fence in the adjoining subdivision in Ms. Ruona’s back yard. The Commissioners have arranged for the Sheriff’s office to visit the property.

Commissioner Cruser stated she wanted to address morale issues regarding employees, she has been told the morale is low. Discussion followed. The financial training session that was held regarding the payroll change did not have a good turnout. The class was more focused on stress over finances then financial training. The time card due date was discussed.

Coroner Rost discussed the burial rules for the County and the City. The County has an Ordinance that regulates burial, the City does not and is in the process of creating one.

Angela Ruona, appeared before the Board regarding the pigs adjacent to her property and her fence. Ms. Ruona was told by a Sheriff’s Deputy, City Officers, and Noe Garza, Code Enforcer for Elmore County, that nothing could be done, that a law suit needed to be filed by the affected property owners against the property owners of the pigs. Chairman Shaw phoned Sheriff Layher. Sheriff Layher stated he would call the property owners.

Noe Garza, Code Enforcer, joined the meeting. Discussion followed on the Hughes property. Friends of the Hughes appeared when Mr. Garza was at the property. Mr. Garza stated they brought water for the pigs and are on their way to Ms. Ruona’s house to offer to fix her fence.
