MINUTES
December 31, 2007
The Elmore County Commissioners met on the above date in the Commissioner’s
Room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain
Home, Idaho.
Present at the meeting were Chairman Larry Rose and Commissioner Connie Cruser.
Commissioner Arlie Shaw was absent. Also present was Clerk Marsa Grimmett and
Civil Attorney Richard Roats.
Members from the newly formed fire districts, Oasis and Tipanuk, were present to
witness the Board approve the Orders approving the forming of the fire districts
from the elections held in November.
Chairman Rose read the Minute Entry and Order in the Matter of the Tipanuk Fire
Protection District. Pursuant to Minute Entry and Order dated July 30, 2007, an
election to determine whether or not the Tipanuk Fire Protection District should
be organized was set for November 6, 2007, a Notice of Election was published in
accordance with Idaho Code Section 31-1405 and said election was conducted in
accordance with Section 31-1406. On November 13, 2007, the Elmore County Board
of Commissioners met in the Commissioner’s Room at the Elmore County Courthouse
to canvass the results of said election in accordance with Idaho Code Section
31-1407; the official results being: Yes 32 No 5 NOW THEREFORE BE IT RESOLVED by
the Board of Elmore County Commissioners that the Tipanuk Fire Protection
District shall and is organized as a Fire Protection District under the name
designated herein above and that the boundary of said Fire Protection District
includes the real property described on Exhibit “A” annexed hereto. BE IT
FURTHER RESOLVED that this resolution shall be in full force and effect from and
after its passage and adoption, and that the Chairman of the Board of County
Commissioners of Elmore County shall be empowered to sign this resolution and
that it be attested by the Clerk of the Board. PASSED AND ADOPTED UNAMINOUSLY BY
THE BOARD OF ELMORE COUNTY COMMISSIONERS THIS 31ST DAY OF DECEMBER, 2007. BOARD

Chairman Rose read the Minute and Entry Order in the Matter of the Oasis Fire
Protection District. Pursuant to Minute Entry and Order dated June18, 2007, an
election to determine whether or not the Oasis Fire Protection District should
be organized was set for November 6, 2007, a Notice of Election was published in
accordance with Idaho Code Section 31-1405 and said election was conducted in
accordance with Section 31-1406. On November 13, 2007, the Elmore County Board
of Commissioners met in the Commissioner’s room at the Elmore County Courthouse
to canvass the results of said election in accordance with Idaho Code Section
31-1407; the official results being: Yes 55 No 1. NOW THEREFORE BE IT RESOLVED

Motion by Rose, second by Cruser, to approve the Minute Entry and Order in the
matter of the Oasis Fire Protection District.

Rick Layher came before the Board to discuss the County’s Agreement for the
Placement of Idaho Department of Correction Inmates in the Elmore County Jail.
On page 3, number 10, it reads: Term and Termination: This agreement will
commence as of December 31, 2007 and shall continue in full force and effect
through December 31, 2008 which was changed to read June 30, 2008.
Motion to approve the Agreement with the Idaho Department of Correction for
Placement of Idaho Department of Correction Inmates in the Elmore County Jail by
Rose, second by Cruser.

Motion to approve the minutes of December 17, 2007 by Cruser, second by Rose.

Bob Knight, Growth and Development Planner, presented the Board with the plat of
Desert Sky Subdivision. The Plat was reviewed.
Motion to accept the final plat of Desert Sky Subdivision by Rose, second by
Cruser.

Wade Baumgartner, Veterans Service Officer, came before the Board to report on
current activities in the Veteran’s Service Office.
Motion by Rose, second by Cruser, to go into Executive Session pursuant to I.C.
67-2345(d) to meet with Social Services Director Marianne Bate. Roll call vote
taken.

Chairman Rose read a tax cancellation into the record: No. 918 Freedom Lanes
$263.90. Motion by Rose, second by Cruser to approve the tax cancellation as
read.

Motion by Rose, second by Cruser, to approve the Financial Status Report Request
for Reimbursement for the Pine/Featherville Fuels Reduction Fire Break project
with the Idaho Department of Lands. The document was received from Joe Twitchell
who represents the RC&D. by Rose, second by Cruser.

Daryl Rhead, Realtor, came before the Board to see if the final plat for Desert
Sky Subdivision was approved. The Board replied it had been.
