The Elmore County Commissioner’s met in regular session on the above date in the
Commissioner’s room, basement of the Elmore County Courthouse, 150 South 4th
East, Mountain Home, Idaho.
Present at the meeting were Chairman Larry Rose, Commissioners Connie Cruser and
Arlie Shaw. Also present were the Clerk, Marsa Grimmett, and Civil Attorney
Richard Roats.
Motion to go into Executive Session pursuant to I.C. 67-2345(d) by Rose, second
by Shaw. Roll call vote taken.

CRUSER - AYE Motion carried and so ordered.
Regular session resumed. No action was taken as result of the Executive Session.
Motion by Rose, second by Cruser to recess for lunch.
At 1:30 p.m. the Commissioners met in Executive Session pursuant to I.C.
67-2345(d) on a motion by Rose, second by Shaw, to meet with Social Services
Director Marianne Bate. Roll call vote was taken.
K-06-07-05 Motion by Cruser, second by Shaw, to deny as incomplete, no interview
or documentation, not last resource and can self pay over a five year period.

K-06-07-03 Motion by Shaw, second by Cruser, to deny as incomplete, no interview
or documentation, not last resource as can self pay over a five year period, and
applicant failed to show for the interview appointment which was made by the
applicant.

Still in Executive Session a hearing was held on K-04-07-02. Present at the
hearing were the three Commissioners, Civil Attorney Roats, Social Services
Director Marianne Bate and Deputy Clerk Barbara Steele. No representatives from
the hospital or the applicant appeared.
Motion by Rose, second by Cruser to make a final denial on K-04-07-02 for lack
of information.

Still in Executive Session a hearing on K-05-07-09 was held. Present at the
hearing were the three Commissioners, Civil Attorney Roats, Social Services
Director Marianne Bate and Deputy Clerk Steele. No representatives from the
hospital (St. Alphonsus Regional Medical Center) were in attendance and the
applicant was not present. The applicant did not appear for the first hearing or
this hearing and the hospital indicated they would try to locate the applicant
and they were unable to do so. Motion by Rose, second by Cruser, to issue a
final denial on K-05-07-09.

Still in Executive Session a hearing on K-04-07-04 was held. Present at the
hearing were the three Commissioners, Civil Attorney Roats, Social Services
Director Marianne Bate and Deputy Clerk Steele. The applicant and her spouse
were present. Social Services Director Marianne Bate gave an overview of the
case. The applicant was asked questions and she stated they could make monthly
payments to the hospital. Motion by Cruser, second by Shaw, to deny K-04-07-04
as not indigent, can self pay over a five year period.

First Class, Inc for the TKL Dairy Open House.

The War Memorial documents were reviewed by the Commissioners that were received
from Alan Baumgardner, Veterans Service Officer. Civil Attorney Roats will
review the documents.
Motion by Rose, second by Cruser, to approve and adopt the Resolutions for the
Title II and Title III funds.

Secure Rural Schools and Community Self-Determination Act
Resolution No. 394-07 for Elmore County
Purpose: Designation of the Amount of Funding to be Assigned to Title II and
Title III Projects.
Whereas, Counties having United States National Forests within their boundaries
have received Forest Service payments for roads and schools under the terms of
the Agricultural Reapportionment Act of 1908; and
Whereas, in the past decade federal land use policy has shifted away from a
multiple use approach to one in which decisions are made on a centralized basis
with great attention being given to single uses; and
Whereas, this approach has had a devastating negative impact on funding for
schools and roads in forest counties; and
Whereas, the 110th Congress of the United Stated passed P.L. 110-28 which seeks
to maintain multiple use land management and reconnect local communities with
management decisions made about their national forests; and
Whereas, Congress had made provisions for local projects under Title II and III
of P.L. 110-28 whereby local Resource Advisory Committees will recommend
projects which will enhance the safety and health of forests as well as enhance
activities conducted within the National Forests with county boundaries.
Therefore, be it resolved that Elmore County intends to allocate the portion of
funds which it receives for projects through the safety net payment in the
following manner: Title II 5% and Title III 15%; and
Be it further resolved that a copy of this resolution be transmitted to the
Governor of the State of Idaho by such date as may be necessary for it to reach
the United States Secretary of Agriculture by September 30, 2007; and
Be it further resolved that this action be communicated to all jurisdictions in
this county which receive Forest Reserve payments.

Secure Rural Schools and Community Self-Determination Act
Resolution 395-07 for Elmore County
Purpose: Designating 15% to 20% of the Safety Net Full Payment Amount to be
Allocated to Local Projects.
Whereas, counties having United Stated National Forests within their boundaries
have received Forest Service payments for roads and schools under the terms of
the Agricultural Reapportionment Act of 1908; and
Whereas, these receipts were a regular but cyclical source of revenue for
schools and counties during most of the last century; and
Whereas, federal land policies during the past decade have shifted away from
multiple use land management; and
Whereas, Congress has recognized these policy shifts have negatively impacted
local communities and the health of our National Forests; and
Whereas, Congress passed P.L. 110-28 which seeks to reconnect local communities
with decisions made on their national forests and invest in improving the health
of our forests and watersheds; and
Whereas, P.L. 110-28 makes provisions for safety net payments to counties with
either 15% or 20% of these funds being allocated to projects which would enhance
the health and safety of US National Forests under Title II and III. Counties
receiving less than $100,000 may elect to allocate 0% to Title II and III.
Be it therefore resolved that Elmore County, which has elected to receive safety
net payments under the provisions of P.L. 110-28, hereby designates 20% of its
safety net payments to be allocated to Title II or Title III projects under this
legislation; and
Be it further resolved that this election be communicated to the Governor of the
State of Idaho by September 30, 2007; and
Be if further resolved that this action be communicated to all jurisdictions in
this county which receive Forest Reserve payments.

John Root and representatives from the Tipanuk area appeared before the Board to
discuss creating a Tipanuk Fire District. The Commissioners received a packet
from the Election Clerk Vivian Garcia. Discussion followed on the publication of
the public hearing.
Motion by Cruser, second by Rose, to accept the petitions to create a Tipanuk
Fire District and set a public hearing for August 27, 2007 at 4:00 p.m. second
by Rose.

The public portion of the meeting was next. Larry Lasuen appeared before the
Board regarding his Board of Equalization appeal on his Mother’s cabin in Pine,
Idaho. He brought pictures of the property which he presented to the Board
showing the Feather River and South Fork River.
The Certificates of Residency were read into the record by Chairman Rose:
Timothy Scott Whitmarsh, Stephanie M. Santos, Sheena Marie Nelsen, Ramona Erika
Junger, Craig Anthony Handy, Travis R. Eikeness, Heather M. Bonorato, and
Marcella Ambriz.
Motion by Rose, second by Shaw, to approve the Certificates of Residency as
read.

The County’s Blue Cross insurance rates were reviewed. The Commissioners choose
the option to increase the deductible to $3,000.00.
