COMMISSIONERS MINUTES                                  AUGUST 21, 2006

 

The Elmore County Commissioners met in regular session on the above date in the basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

 

Present at the meeting were Chairperson Mary Egusquiza, Commissioners Larry Rose and Connie Cruser.  Also present was Clerk Merrilee Hiler.

 

At 1:30 p.m. on a motion by Egusquiza, second by Rose, the Commissioners met in Executive Session pursuant to Idaho Code 67-2345(d) with Social Services Director Marianne Bate.

A letter to Karl Dreher, Department of Water Resources was reviewed.  The draft letter was revised, to be signed when the revision is made. The letter regards the increase in proposals for residential development in unincorporated areas of the County.

 

Motion by Egusquiza, second by Rose to go into executive session Pursuant to Idaho Code 67-2345(d) with Juvenile Probation Supervisor Monica Halliday and Judge David C. Epis.

Judge Epis will review the Juvenile Mental Health Memorandum of Understanding.   Monica Halliday will compare costs between Ada County and Canyon County for the Juvenile Detention Contract that is coming up.  Both matters will be put on the calendar for the September 5, 2006 Commissioners meeting.

 

Elmore County Disaster Services Director Nick Schilz presented information on the current situation regarding the West Nile infestation of mosquitoes.   The City of Mountain Home is also addressing this situation. Motion by Egusquiza, second by Rose, to sign Declaration of Disaster Resolution No. 376-06.

ELMORE COUNTY

DECLARATION OF DISASTER

RESOLUTION NO. 376-06

 

WHEREAS, The Elmore County Board of Commissioners, pursuant to Idaho Code Section 46-1011, has the authority to declare a state of local disaster emergency regarding Elmore County, Idaho; and

 

WHEREAS, the imminent threat of widespread illness and potential loss of life in Elmore County as a result of West Nile infestation, constitutes a “disaster”; and

 

WHEREAS, as of August 21, 2006 Elmore County has had 19 confirmed cases of persons infected with West Nile (per Central District Health Department) and 3 possible related deaths in Elmore County; and

 

WHEREAS, an emergency exists because a West Nile Virus disaster is imminent and threatens further widespread illness and potential loss of life of persons in Elmore County and requires state emergency assistance to supplement local efforts to protect life and property; and

 

WHEREAS, The Elmore County Board of Commissioners request that the Governor of the State of Idaho, together with other appropriate state officials, together with other appropriate federal officials, made such declarations, and provide such assistance within Elmore County as are required and allowed by law.

 

NOW, THEREFORE, BE IT RESOLVED That Elmore County Board of Commissioners does hereby declare, pursuant to Idaho Code Section 46-1011, a local disaster emergency to exist in Elmore County, Idaho; and

 

BE IT FURTHER RESOLVED, That the Governor of the State of Idaho be advised of this local disaster emergency and is requested to take all action available for him for amelioration of the above described local disaster emergency; and

 

BE IT FURTHER RESOLVED, That the Elmore County Recorder be directed to properly file this Resolution pursuant to Idaho Code Section 46-1011.

A task force will be formed with the first meeting to be on Wednesday, August 30, 2006 at 7 p.m. in the Commissioners room of the Elmore County Courthouse.  Nick will get the Declaration to the governor and the notice to the paper of the Declaration and the formation of the task force.    Letters to various entities, agencies and interested parties will also be sent out to ask for their assistance in this task force.

 

Deputy Barbara Steele brought the revised water resources letter to Karl Dreher in for signature.  Chairperson Egusquiza signed the letter.

 

Joe Twitchell, 3064 NE Twitchell Drive, Mountain Home, ID, gave his report on the Southwest Idaho RC&D.  Their projects include reduction of fire fuels on private lands, Urban Community issues, culvert inventory, a National Animal Identification System, and an RV Dump site by Pine property owners.  He also outlined a grant for Hazardous Fuels Treatment projects on non federal lands for $82, 950.00 which has to be in by September 1, 2006.  It is not a matching fund for the County to put money toward.  RC&D will put $3,800.00 toward it with the remainder coming from the property owners.  He is requesting a letter from Elmore County stating RC&D can apply for the grant for the county.

 

Motion by Egusquiza, second by Cruser to go into executive session pursuant to I.C. 67-2345(d) with Social Services Director Marianne Bate regarding K-05-96-04 on a refinance request.

Regular session resumed.  No action was taken as a result of the executive session.

 

Sheryle Landon, 3350 East 36th South, Mountain Home, Idaho, representing the Mountain Home Museum, requested information regarding the status of the museum telephone expenditure line item.  The line item is overdrawn at this time.  This will require the Museum to pay any telephone bills remaining this fiscal year.  Next year (FY 2007) the County will pay the Museum their allocated budget line items at one time so the Museum can pay their own telephone bill.  This should help them to be better able to track their expenses.

 

Sheryle also brought her information to apply for an Idaho Waste Community Grant for the Museum.  Larry Rose, Barbara Steele, Dan Collins, and Fred Perez are on the Committee to review that grant proposal.  She also inquired as to whether the Mountain Home Visitors Center had received any funding from the County for FY 2007.  It has been funded for $5000.00.

 

Kelly Rodgers, 2091 W. Hill Rd, King Hill, ID and Shannon Jones, 2451 E Little Basin Rd., King Hill ID, appeared with questions regarding the appointment and terms of Fair Board Members and if the Commissioners could remove a member from the Fair Board.  They also discussed the Elmore County Fair Queen contest that was cancelled.

 

Elmore County Prosecutor Tina Shindele brought the Notice of Deficiencies and Contract of Termination in for signature.  Chairman Egusquiza signed the Notice.

 

Prosecutor Schindele indicated she is still researching the fireworks ordinance.  She will have the All Hazards Mitigation Ordinance done by next Monday for review and approval.

 

A letter from Moore Smith Buxton & Turcke, Chartered, regarding a delinquent tax notice for the City of Glenns Ferry was reviewed.  Prosecutor Schindele will look into the matter.

 

Motion by Egusquiza, second by Cruser to approve the Findings of Facts and Conclusions of Law on the Ontiveras/Ayala Appeal.

An Idaho Power bill of $52, 093.00 for the new jail on an Underground Primary Extension to the new jail that was sent to the County instead of the Architect was discussed.  Clerk Hiler has been in contact with Russ Moorehead regarding this charge.  Russ is to get back with her with more information.

 

Change orders 1, 2, 3, and 4 for the new jail were also discussed by all, and then signed by Chairperson Egusquiza. 

 

Certificates of Residencies were read into the record: Linda M. Patterson and Cesar Gomez.  Motion by Egusquiza, second by Rose to approve the Certificates as read.

The Commissioners requested the Windpower Ordinance be put back on the Calendar for September 5, 2006.
