COMMISSIONERS MINUTES                                    JULY 10, 2006

 

The Elmore County Commissioners met in regular session on the above date in the basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

 

Present at the meeting were Chairperson Mary Egusquiza and Commissioners Larry Rose and Connie Cruser.  Also present at the meeting were Clerk Gail Best, Chief Deputy Clerk Merrilee Hiler, Deputy Auditor Deb Prazak, and Mir Seyedbagheri County Agent.

 

Budget workshops were held for Noxious Weed, County Agent and Pest budgets. 

 

There was discussion about pre-approvals being noted on expense items for anything over $3,000.00.  A line will be added to the claim voucher for these items and those special claim vouchers will be stored in the Commissioner’s Room so they can sign their approval prior to the departments turning the vouchers in to the Auditor’s office for payment.

 

Sheriff Rick Layher and Chief Deputy Sheriff Nick Schilz appeared to discuss budgets.  Budget workshops were held for Sheriff, Dispatch, Glenns Ferry Police Contract, Idaho Youth Plates and Jail.

 

Bob Stephenson appeared before the Board for a budget workshop on the Data Processing budget.

At 1:30 p.m. the Commissioners met in Executive Session pursuant to I.C. 67-2345(d) on a motion by Egusquiza, second by Rose to meet with Social Services Director Marianne Bate and Social Services Secretary Katrina Welch.

The following decisions were made:

 

K-05-06-12 Motion by Rose, second by Egusquiza, to approve as the applicant does not have the means to pay this amount over a 5 year period, she is a resident of Elmore County and she is indigent under the statute, with a promissory note in the amount of $50.00 per month to be reviewed yearly.

At 2:00 p.m., still in Executive Session, a hearing was held on K-07-05-02.  Present at the hearing were the three Commissioners, Prosecutor Schindele, Social Services Director Marianne Bate and Social Services Secretary Katrina Welch, Deputy Clerk Steele, Bonnie Miller representing Elmore Medical Center and Jennifer White from St. Alphonsus Regional Medical Center.  The applicant and her husband were also present.  Social Services Director Marianne Bate gave a brief overview of the case.  Ms. White from St. Alphonsus is asking for a continuance for more time to investigate the insurance company’s denial.  Prosecutor Schindele offered her suggestion to the Board that a continuance would be acceptable.  Motion by Egusquiza, second by Cruser, to continue case K-07-05-02 for 120 days to determine if the County is the last resource.

Regular session resumed.

 

At 3:00 p.m. a public hearing was held on a proposed ordinance regarding code enforcement.  There being no one present to testify, the hearing was closed.

 

Motion by Egusquiza, second by Rose, to go into Executive Session pursuant to I.C. 67-2345(d).

A hearing was held on case K-05-06-10.  Present at the hearing was the three Commissioners, Prosecutor Schindele, Social Services Director Marianne Bate, Social Services Secretary Katrina Welch, Deputy Clerk Steele and the applicant.  Social Services Director Marianne Bate gave a brief overview of the case.  The applicant gave the Board a copy of a letter regarding his unemployment benefits stating they will run out soon.  The case was discussed in length.  Motion by Rose, second by Cruser, to approve two medical tests with a payback agreement of $50.00 per month to begin on September 15, 2006 with the payment amount reviewed yearly.

Motion by Egusquiza, second by Cruser to approve the payroll for June 2006 in the amount of $301,319.03.

Expenses were discussed.  One submitted by the Coroner was pulled and questioned.  Motion by Egusquiza, second by Connie to approve the expenses with the exception of the one submitted by the Coroner.  Total expenses $354,900.01.

Present were the three Commissioners, Deputy Clerk Steele and Chief Appraiser Jody Soboslai.

 

Fred and Patty Kennedy’s appeal on Parcel Number RP03N10E097290A was discussed.  The Assessor’s office reduced the amount from $36,044 to $13,375.  Motion by Egusquiza, second by Rose, to uphold the adjusted Assessor’s assessment on parcel #RP03N10E097290A.

Ralph and Patti J. McGrath’s assessment appeal was discussed.  The Assessor’s office took off 10% due to limited frontage compared to the other adjacent properties.  The land assessment was $110,000 now it is $99,000.  Motion by Egusquiza, second by Rose, to uphold the amended Assessor’s assessment on RP00148002016AA on Ralph and Patti J. McGrath.

The appeal on parcel #RP001700000200A from George Gabbard and Robert Whittekiend was reviewed.  A lease was received from one partner (Mr. Gabbard) to another partner.  Ms. Soboslai told the board it was not a legitimate lease.  She recommended no reduction in the already corrected assessed value.  Motion by Rose, second by Egusquiza, to uphold the corrected Assessor’s office assessment of $69,447.

On Joanne Lanham’s appeal, the Assessor’s office research showed 34 acres instead of 40 acres on the original assessment.  That reduces parcel #RP05S07E024810A from $31,080 to $26,418.  Chairperson Egusquiza disclosed that Ms. Lanham phoned her yesterday to discuss the assessment.  There is no lease on the property for dry grazing and Mr. Ketterling has not run cows on her property.  Motion by Rose, second by Egusquiza, to uphold the Assessor’s office assessment for parcel #RPB0071019002BA and with the above adjustment for parcel #RP05S07E024810A.

Judge Epis appeared briefly before the Board to set up a time for interviews for the opening at the Juvenile Probation Department for a Director.  July 28th starting at 11:00 a.m. was selected and Deputy Clerk Steele will notice up a special session.

 

A public hearing was scheduled for August 14, 2006 at the hour of 3:00 p.m. regarding a proposed Fireworks Ordinance.

 

Cathy Wyllie and the Fair Board members appeared before the Commissioners to review their budget request.  Ms. Wyllie had a question regarding the phone and Commissioner Rose stated that Dan Collins was taking care of it.  She also stated Jason Stone would like to schedule a meeting on July 18th at 10:00 a.m. to travel to the Fair grounds in Glenns Ferry regarding a grant.  Also one Commissioner will attend the Glenns Ferry City Council meeting tomorrow at 7:00 p.m. to talk about the Mixed Martial Arts (Cage Fighting) at the Fair grounds.  Ms. Wyllie also wanted to invite the Commissioners to be a part of the grand entry into the rodeo, the Fair Board members will be riding in the back of a pickup on July 28th and July 29th at 7:30 p.m. and encouraged the Commissioners to participate.

 

The Fair budget was reviewed, including job positions.  The Commissioners advised the Fair Board members to call ICRMP, the County’s Insurance, with any questions regarding employees if any personnel issues arise.  The Fair budget will be revised at the Fair Board meeting that night and will be resubmitted to the Clerk by this coming Wednesday and the Fair budget will be put back on the agenda for 4:00 p.m. on July 17th

 

The public portion of the meeting was held.  John Steiner, 24597 Collett Road, Oreana, Idaho 83650, appeared before the Board with questions regarding the proposed wind tower ordinance.  Work sessions on the proposed ordinance have not been scheduled as of yet.  Mr. Steiner will get the Board some examples of other wind ordinances and information to the Board regarding tax revenue.  Mr. Steiner will be kept informed on any work sessions when scheduled.

 

The next item was for a Letter of Information (lot split) for Matthew Palmer.  Chairperson Egusquiza stated that the taxes are delinquent with the current information that the Board has and the item will be put on the July 17th agenda as a business item.

 

A public hearing on an appeal regarding Jesus Ontiveras and Mario Ayala for a 3 Lot Letter of Information Subdivision filed by the Mountain Home Rural Fire Protection District, was scheduled for August 14, 2006 at 3:30 p.m. 

 

The job description for Code enforcer was discussed.  Deputy Clerk Steele was asked to check the status of  that job description for the Board.

 

Motion by Rose, second by Cruser, to accept and have the Clerk sign the Findings of Facts, Conclusions of Law for Michael Homan and Rick Tullis, Conditional Use Permit for an 84-Lot Platted Subdivision.

Motion by Rose, second by Cruser, to accept and have the Clerk sign the Findings of Facts, Conclusions of Law for Thomas Oblinsky, Conditional Use Permit for a Private Kennel for the purpose of Training and Breeding Dogs.

Correspondence was reviewed.

 

A letter from the College of Southern Idaho was reviewed.  It stated that CSI is asking for the County’s support in changing the residency forms from certification by term (Fall, Spring) to certification by school year (ex. 2006-2007).  This is the type of certification North Idaho uses and it would greatly cut down on time spent by everyone on Spring term.  Approximately 75% of the forms verified by your offices for Spring are students returning from the Fall.  Billings would continue to come the way they currently do.  We do not bill based on a certificate we bill based on a students enrollment for that term.  CSI currently has approval from Ada, Bingham, Boise and Cassia Counties to move to a yearly certification.  The Commissioners discussed the request from the College of Southern Idaho and voted to not support certifying residency forms by academic year rather than by term on a motion by Egusquiza, second by Rose.  Deputy Clerk Steele was asked to send the signed form back to the College.
