COMMISSIONERS MEETING                                  OCTOBER 24, 2005

 

The Elmore County Commissioners met in regular session on the above date in the basement of the Courthouse, 150 South 4th East Street, Mountain Home, Idaho 83647.

 

Present at the meeting were Chairman Larry Rose and Commissioners Mary Egusquiza and Connie Cruser.  Also present at the meeting were Clerk Gail Best, Judge Epis, Sheriff Rick Layher, Captain Lynn McCallum, Chief Deputy Clerk Merrilee Hiler and Ted Knudson, Juvenile/Probation Administrator.

 

Captain McCallum stated that his transport officer works 7:30 a.m. until 4:00 p.m.  After 4:00 p.m. he has to pay the transport officer overtime if transports have to be done after 4:00 p.m.  There are times that juveniles must be transported after 3:30 when they go to Court and detention is ordered.  Captain McCallum stated it would be helpful if those juveniles could be taken out of school in the morning so if they had to be transported, they could be taken to Caldwell early.

 

Judge Epis asked if it would be possible for the transport officer’s hours to be adjusted, for example coming in at 10:00 a.m. to start his shift, so he could stay later?

 

There was general discussion about the transporting of juveniles.  A suggestion was made that perhaps during the next budget cycle, more funds could be budgeted for juvenile transports.

 

Sheriff Layher suggested that they track the juvenile transports for approximately one month, just to see how many juveniles transports we are talking about.  There was further discussion.  The group decided that if it was known there was a juvenile that probably would have to be taken to detention they would try and do so about 11:30 - 12:00.  Any other details arising will be settled by the Juvenile Department and the Sheriff’s Department.

 

Fred Perez of Idaho Waste Systems introduced Cary Languieran and Doug Csonko to the Board.  The parties were before the Board to discuss the processing of tires at Idaho Waste.  Both Mr. Languieran and Mr. Csonka have recently moved to the area to do tire processing.  Mr. Perez stated that he hopes that the entire process will be up and running by January 1.

 

Mr. Languieran stated that they have signed a contract with Lowes for five years to do mulch for them.  Mr. Languieran stated that the mulch made from the tires is nicer than bark and is more durable and also softer for playground areas, as well as being extremely durable.  They are also working with a company in Washington to make a product that will be a fine powder.  The powder is an additive to make other products such as mats, bike tires and a substance to mix in for roads and tarmacs.  They will also be grinding some of the tires up to make fuel to be shipped overseas.  Aside from these items some tires will be shipped to become recapped tires, which there is a large market for in many foreign countries.

 


 

Commissioner Rose asked how many people they might employ?  Mr. Languieran thought at least thirty, and possibly more if more accounts come in.  There was discussion about whether a Conditional Use Permit (CUP) would have to be obtained or not.  Chairman Rose suggested that they speak to Bonnie Sharp at Growth and Development.

 

The elected officials and department heads met with the Board for their regular monthly meeting.  Jim Haydon, Assessor, stated that his office has completed work up in the hills and are back on the flat land.  Jim told the Board that Idaho Power has withdrawn their appeal and so it was dismissed by the Tax Commission.  There is still the issue of occupancy and it is possible that litigation could follow.  Jim reported that Sheriff Layher had asked him for aerial photographs on an area for an upcoming court case, and after review, his black and white aerials would not do, so Jim asked Duane Priest if he could supply one, which he did and the problem was solved.  Jim stated that Duane Priest has been a big asset to his office and to Elmore County so it has been well worth contracting with his firm.

 

Rose Plympton, Treasurer, reported that she had received the certified levies last week.  Her office can now start working on the tax bills.  Prosecutor Schindele stated she and Rose had worked on the wireless and cable bankruptcy and finally settled at 43%, the best deal they were able to get.

 

Kristina Schindele, Prosecutor, reported that she had hired two new attorneys who will be joining the County on November 1st.  Prosecutor Schindele stated she had ten applicants for the two positions and she had interviewed eight.

 

Dan Collins, Plant Facilities Manager, stated his staff was getting ready to secure the doors at the Public Defender’s office when they move out and they also are taking the opportunity of an empty office over at the annex to paint the room.  Dan also reported that he has ordered some equipment for recording meetings that are held off site.  Dan suggested it would be nice if meeting could be held somewhere other than the Legion because the room smells stale, but after discussion it was decided that unless meetings could be done at the Courthouse, there is no other place to hold meetings that is large enough.

 

Bonnie Sharp, Growth and Development Administrator, stated her office is plodding along with their normal routine.  Bonnie reported she has been working on some complaints herself, the most time consuming has been the grain rolling facility.  Nick Nettleton has been excusing himself from voting on CAFO issues, but as a result of getting another opinion on the issue, he is now voting on those issues.  A Letter of Information (LOI) for Eisenman was discussed.  Commissioner Egusquiza stated there is nothing in the record linking the parties with Juniper Farm.  Bonnie will search the file to see if there is a document that does so.

 

Mir Seyedbagheri, County Agent, gave the Board his activity report.  Mir also reported he has been finding potato moths in the potato crop and onion bulb fly which could be a major problem as it causes potato rot.  Mir showed the Board photographs of infected potatoes he had taken earlier this month.  Mir stated that, on the positive side, there is 97% control on the Mormon Crickets this year on the areas that have been treated.

 


 

Tom Gibbon, Chief of Security, reported they have received the other two tasers they had ordered, so now they each have one.  Tom also asked how the Board wanted to handle meetings held in the Courthouse that are not County related.  Tom stated he was worried about his staff building up compensatory time for the extra meetings.  There was discussion as to whether Tom could have some of his staff come in later in the morning when meetings were going to keep them on duty at night.  Tom will give some thought to the suggestion.

Sheriff Layher brought in a new Schematic showing the placement of the jail building.  The Board reviewed the schematic and stated they thought the location would work just fine.

The proposed contract with the City of Mountain Home regarding the Animal Shelter was discussed and will be put on the next agenda.

 

The Martinez Bankruptcy will be put on the next agenda as Prosecutor Schindele was doing some research.

 

Tax cancellations were read into the record by Chairman Rose: No. 771 Idaho Circuit Technology $66.86, No. 783 Wanda Corbus $64.18, No. 785 Ricardo Lopez $18.50, No. 786 Patrick J. & Stephanie A. Foltz-Jones $64.46, No. 788 Mark Hotchkiss $188.30, No. 789 Gregory T. & Pun Yon Lambert $999.24, and No. 790 Elsie Black & Don Corbus $1.86.  The tax cancellations were tabled until some clarifications could be made.

 

The Mountain Home Fire District Annexation request was discussed.  It was decided to wait until Prosecutor Schindele appeared.

 


 

Building permit fees were discussed.  It was decided that the Commissioners needed to meet with Myron Adamson, Building Inspector, before any decisions are made.

 

Discussion followed on the E911 full time position.  Commissioner Cruser asked if the position could be part time, Chairman Rose wasn’t sure as attending school will be involved.  The Commissioners will talk to Bonnie Sharp, Growth and Development Administrator, about it.

 

John Robison from the Idaho Conservation League and Jessica Ruehrwein from the Sierra Club, appeared before the Board to discuss the Atlanta Gold Mining Project.  Mr. Robison explained the current arsenic problem in Atlanta now and the clean up efforts.  He then talked about the upcoming meeting on the proposed Atlanta Gold Mine, they have placed ads in the Mountain Home News and on billboards to seek public interest.  The groups also had pamphlets handed out to residents with a questionnaire asking for comments from citizens to be sent to the County Commissioners, c/o Idaho Families for Clean Water, P. O. Box 552, Boise, Idaho 83701.  A brief overview Wednesday’s upcoming meeting was given.  Mr. Robison stated the County could put in place an Ordinance regarding mining which would give Elmore County adequate local control and protection.  The Commissioners thanked Mr. Robison and Ms. Ruehrwein.

 

Teri Lasuen from the Treasurer’s Office appeared and answered the tax cancellation question.  Motion by Egusquiza, second by Cruser, to approve the tax cancellations as read.

Commissioner Egusquiza asked Deputy Clerk Barb Steele if she could do two letters of support for the Mountain Home Highway District for grant applications for the Pine bridge and the Neil bridge.  Ms. Steele replied yes.

 

Prosecutor Schindele appeared and the Commissioners asked her about the Mountain Home Fire District Annexation request.  Prosecutor Schindele replied she would like to see an affidavit of publication regarding the public hearing of annexation and a recordable order prepared on the annexation. 

 

Motion by Egusquiza, second by Rose, to approve the ambulance district’s expenses.

Ted Knudson and Jason Stone appeared before the Board.  Ted explained that Jason is a grant writer and is interested in doing some work for Elmore County.  Jason told the Board that he felt Elmore County could benefit from his services by finding some much needed funds to help finance some of the things they wanted to accomplish.


 

Vivian Garcia, Deputy Clerk, appeared before the Board to discuss the junior college certificates of residency process.  The discussion centered around how the County might be able to tell which applicants were still high school students.  It was decided that another session be scheduled early in the day on another agenda when the College of Southern Idaho could be telephoned so the Board could ask Dawn Orr of the Business Office questions.

 

Ramona Yrazabal, 1685 East 6th South, Mountain Home 83647, appeared before the Board during the public portion of the meeting to discuss the formation of the Pine/Featherville Fire District.  Ms. Yrazabal stated she was sorry she had missed the public hearing held in Pine and just wanted to ask some general questions.  The Board recapped the hearing for Ms. Yrazabal and answered the general questions she had regarding the formation of the District and the upcoming election.

 

Phil Miller appeared before the Board during the public portion of the meeting to discuss the County’s easement issue.  Mr. Miller stated that Robin Brody, the attorney for the Desert Sage Health Center had changed some of the language in the agreement and he wanted to bring it before the Board.  The Clerk will schedule an appointment for Mr. Miller to do so.

 

Terry Ratliff, who will be the new contract Public Defender reported that he wanted to update the Board on his progress so far.  Mr. Ratliff stated he has already begun handling clients and cases and has about 2/3 of the cases read and assigned already.  As per agreement Mr. Frachiseur will keep the Valen case to finish it out.

 

Bonnie Sharp appeared to discuss the final plat for Montrose Estates Subdivision.  The Board reviewed the plat.  Motion by Egusquiza, second by Cruser, to approve the Montrose Estates Subdivision final plat.

The LOI’s from earlier in the day were discussed.  The LOI for Eisenman was remanded back to Growth and Development for further work.

 

The LOI for Ericson and Bickle was reviewed.  Motion by Egusquiza, second by Cruser, to approve the 4-Lot Letter of Information for Spike Ericson and Jody Bickle with no conditions.

The LOI’s for Reyes Lopez was reviewed.  Motion by Egusquiza, second by Cruser, to approve the LOI’s for Reyes Lopez.  There was discussion regarding putting on a condition that no lots be sold until he has complied with the recommendations of the Mountain Home Rural Fire District.  Motion and second were withdrawn until the Board knows just what recommendations were made by the Fire District.
