COMMISSIONER MINUTES SEPTEMBER 19, 2005

The Elmore County Commissioners met in special session on the above date at the hour of 1:00 p.m. in the basement of the Elmore County Courthouse, 150 South 4th East Street, Mountain Home, Idaho.
Present at the meeting were Chairman Larry Rose and Commissioners Mary Egusquiza and Connie Cruser. Also present was Clerk Gail Best.
The replies to the Request for Proposals for the Public Defender position were opened. There were three responses.
Andre Lawson - 290,000.00
Tyler Smith, Philip Gordon, and Ed Frachiseur - $372,000.00
Terry Ratliff - $318,361 with some provisions for negotiations.
The Board will review those proposals.
The Board began work on the Confined Animal Feeding Operation (CAFO) Ordinance. On page 5 - CLOSURE PLAN after the definition add:
a. The estimated length of operation of the facility; and
b. A description of the procedures, methods, and schedule to be implemented at the facility for final disposal, handling, management and/or treatment of all animal waste.
On page 7 - PUBLIC RIGHTS OF WAY- remove the dash and us a colon
On page 10 - item 11 remove the words continued proof of liability insurance in the second sentence and the work annually from the third sentence.
On page 10 - add a space between items 3 and 4
On page 11 - item 3 first line last sentence after word three put (3)
On page 18 - item F should read “For all CAFO facilities of 1,000 or more animal units managing liquid waste continued proof of liability insurance shall be submitted to the County.
On page 18 - add an item G and move what is currently in F down to G.
On page 13 add (3) after the word three. New line will read: Swine and Poultry expanding CAFO Facility Areas shall be located a minimum of three (3) miles outside any Area of City Impact.
Page 2 - Shall be known as Chapter 3
The Commissioners discussed the Planning and Zoning Commission and any input they might have. Deputy Clerk Steele was instructed to get a copy of the draft CAFO Ordinance to the Growth and Development Department so the P &Z Commission could review it and offer any input they might have by September 26, 2005.
The Public Hearing for the draft CAFO Ordinance will be held on Thursday, October 13, 2005 at 7:00 p.m. in the Commissioners Room, basement of the Elmore County Courthouse.
