COMMISSIONERS MINUTES SEPTEMBER 6, 2005

The Board of Elmore County Commissioners met in special session on the above date in the basement of the Courthouse, 150 South 4th East, Mountain Home, Idaho 83647.
Present at the special session were Chairman Larry Rose, and Commissioners Mary Egusquiza and Connie Cruser. Also present at the session was Clerk Gail Best.
The first order of business was to sign a request for funds presented by Laytreda Schultz, representing Waterways. Motion by Rose, second by Cruser, to direct the chair to sign the request for funds in the amount of $12,951.00 which is reimbursement to be received for the Boating Waterways Safety Grant which was approved earlier in the year.

Motion by Rose, second by Cruser, to approve claim number K-04-05-05 in the amount of $10,000.00.

The main focus of the special session was for the Board to work on the Confined Animal Feeding Operation (CAFO) ordinance. The Board began their work on page 11, VII, #2, third line “Elmore County and “the legally described perimeter of Mountain Home Air Force Base”.
The last sentence in the current #2 will become #3:
3. New Swine and Poultry Facility Areas shall be located a minimum of three miles outside any Area of City Impact.
Current #3 becomes #4 and so on, ending with #8.
On page 13, VIII, #2, third line “Elmore County and “the legally described perimeter of Mountain Home Air Force Base”.
The last sentence in the current #2 will become #3:

Current #3 becomes #4 and so on, ending with #9.
Page 16, Item C, third line: “to show proof of measurable progress toward a completed project must be presented before the Commission”.
Page 16, Item C, fifth line: “been completed. If the CAFO is not a working CAFO within five years of the permit being issued, the Commission may revoke the permit.”
Page 17, Item C, sixth line: “Inspector or the Idaho “State” Department of Agriculture......”
Page 19 - need to change signature lines to reflect a signature line for Commissioner Cruser.
There was further discussion regarding the draft.
Page 5 - after the definition for CAFO SITE ADVISORY TEAM:
CLOSURE PLAN: A plan describing the procedures for final closure of a facility that ensures no adverse impacts to the environment and waters of the state.
The Board asked that a new draft be done prior to the CAFO workshop meeting scheduled for September 19th. Clerk Best was directed to get a draft to the Prosecutor so that she could determine whether or not the changes made would amount to a material change and require a public hearing.
The Code of the West was discussed. The Board stated that they were happy with the booklet with the positive message placed in the beginning of the booklet. Chairman Rose asked Clerk Best if she thought the budget would tolerate the sum of $1,000 to be given toward the cost of having booklets printed? Clerk Best stated it would and said she would get the claim form ready for the next meeting on the 12th.
