COMMISSIONERS MINUTES                                                AUGUST 2, 2004


The Elmore County Commissioners met in special session on the above date in the Commissioner’s Room, basement of the Elmore County Courthouse, 150 South 4th East, Mountain Home, Idaho.

Present at the meeting were Chairperson Mary Egusquiza, Commissioners Larry Rose and Calvin Ireland. Also present were Clerk Gail Best and her Chief Deputy Merrilee Hiler.

The purpose of the special meeting was for Clerk Best to present a tentative budget to the Board and for the Commissioners to make any adjustments to the budget that are necessary. Clerk Best stated that cuts need to be made to the budget in order to stay under the maximum levy rates and the 3% cap. Clerk Best stated she had talked with Sheriff Layher and he is willing to give up the two new deputies and one new jailer if necessary as well as the two automobiles for the new deputies, but that still was not enough to make the budget work.

There was a lengthy work session trying to adjust the budget. The remedies were to put the items back into the Current Expense Fund from the Justice Fund such as postage, gasoline, health care deductibles, unemployment insurance, telephone and workmen’s compensation that were placed there to better account for law enforcement expenses. The Board also moved Security out of the Justice Fund into Current Expense and the Public Defender out of Indigent into Current Expense.

Commissioner Rose asked if after those adjustments, could one of the Sheriff’s new deputies and automobile be saved? Clerk Best thought that was possible. The Adult Misdemeanor Probation position was discussed since Ms. Crogg would be doing the adult community service coordination now as well. Motion by Egusquiza, second by Rose, to give Ms. Crogg one additional step merit increase to Grade 8, Step 6.

Hearing on K-04-04-11 was held. Present were the three Commissioners, Indigent Director Marianne Bate, Deputy Prosecuting Attorney Teri Kaptein, and the applicant. No one appeared from St. Lukes Regional Medical Center. The applicant withdrew the application. Motion by Egusquiza, second by Ireland, to deny as not last resource.

Hearing was held on K-04-04-04. Present at the hearing were the three Commissioners, Indigent Director Marianne Bate, Deputy Prosecuting Attorney Teri Kaptein, Deputy Clerk Barb Steele, Steve Jensen and Raven Wilkerson from St. Alphonsus Regional Medical Center, and the applicants wife and daughter. The applicant was not present. The applicant’s wife was asked several questions by all the parties. Motion by Ireland, second by Rose, to continue the hearing as the 2003 applicant’s income taxes are not done yet and should be complete within the next two weeks.

Present at the hearing were the three Commissioners, Indigent Director Marianne Bate, Deputy Prosecuting Attorney Teri Kaptein, Deputy Clerk Barb Steele, Steve Jenson and Raven Wilkerson, St. Alphonsus Regional Medical Center, and the applicant. Several questions were asked by all parties. Motion by Ireland, second by Rose, to approve with a promissory note in the amount of $25.00 per month.

Discussion followed and the applicant was asked several questions. The hearing was closed.

Present at the hearing were the three Commissioners, Indigent Director Marianne Bate, Deputy Prosecuting Attorney Teri Kaptein, Deputy Clerk Barb Steele, Steve Jensen and Raven Wilkerson, St. Alphonsus Regional Medical Center, and the applicant and his wife. Questions were asked and answered. Motion by Egusquiza, second by Ireland, to continue the hearing to August 23, 2004 to obtain a date on the application for SSI.

The Board and Clerk Best discussed transfers from the Pilt Fund to be made for the 2005 budget. Clerk Best will make whatever transfers are necessary to make the budget work.
