JURY DUTY
Welcome to Jury Service for Elmore
County. CLICK HERE FOR JURY INSTRUCTIONS If you have questions or
concerns regarding your jury service, please call the jury clerk at
587-2135, Ext. 285 between 8am & 5pm. HOW DID I GET CHOSEN FOR JURY DUTY?
A juror is chosen from a random list of registered voters and licensed drivers. A Juror Summons and Jury Qualification form are then sent to the juror which is filled out and returned to the Court within ten (10) days. The questions are asked to determine if the juror is legally qualified to serve on a jury. The answers to the questions help the Judge and attorneys determine the jurors’ fairness and ability to sit as a juror on any particular case. I AM ACTIVE MILITARY AND NOT A RESIDENT OF THIS STATE, DO I HAVE TO SERVE? Yes, the JAG has issued an Order regarding your jury service as an active duty serviceman.
WHAT IF I HAVE PRIOR COMMITMENTS? If the commitments cannot be rescheduled, you will have two options. 1) You may ask for a postponement, in writing, to the next session (only one postponement is allowed) or 2) you may provide itineraries for travel and you will be excused for that period of time only. If you are required to be out for medical reasons, a note from your Dr. will be required for any postponement. The jury clerk cannot excuse for hardship, this must be discussed with the presiding Judge in open court. WHAT IF I HAVE AN EMERGENCY? If you have an emergency situation, call the jury clerk to discuss your options. WHAT IF I DON'T RETURN MY QUALIFICATION FORM? You will be mailed a reminder card after ten (10) days asking you to complete and return your Jury Qualification form. If you still do not return it within ten (10) days, a warning letter will be sent to you advising you that an Order to Show Cause will be issued. If you still do not return the qualification form, an Order to Show Cause will be served upon you and you will be required to appear before the Administrative Judge. If you fail to show good cause for noncompliance, you are guilty of criminal contempt and may be fined not more than $300.00 or imprisoned in the county jail not more than three (3) days, or both. Idaho Code 2-217.
WHAT IF I FORGET TO CALL?
While it is important that you remember to call when instructed, it sometimes happens. If so, you may access the message through the above instruction link at any time. The Jury Information Line will always have the recorded message after 5:30 p.m. weekdays and any time during the week-end or you may call the jury clerk during normal business hours.
